The Collapse of the 28-Point Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the presentation of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The sequence of conflicting incidents captured the grim essence of the outgoing year. By day, diplomatic battles are conducted: hopeful statements are delivered from multiple capitals. Significant resources is expended on containing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the key method for achieving "settlement".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was exposed. Ukraine is able to track rocket firings from across the border, a ability afforded by up-to-date information. From observation points, military aircraft that had been deployed to intercept incoming guided weapons streaked across the sky – modern combat jets provided to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense engaged: multiple launches fired to intercept a incoming threat. This was a sophisticated defense system at work, most likely supplied through Western nations. Every launch creates sudden vibrations, causing tremors. The brief panic quickly transforms into grim resignation: perhaps the hostile projectile won't hit its mark this time, preventing destruction from devastation and further power outages.

Continuous Dangers

Soon after, a large-caliber weapon opened up on a aerial vehicle close by, part of a mobile-fire group – probably Western-made equipment. Unfortunately, the projectiles didn't strike the opposing UAV – it maintained course toward its objective.

Periodically, this carried on until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, destruction and infrastructure problems in numerous residences as a result of the night's assault. As typically, everyone still continued their routines – living the war. But those entire period encapsulated Ukraine's critical military reliance on external assistance – a dependence that neighboring countries are evidently unprepared to fill in the short term.

Failed Diplomacy

The 28-point plan from US administration generated strong feelings, debate and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and multilateral gatherings.

Every new proposal from Washington adheres to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, manages to fend off. They contain the crisis but never actually achieve victory. This pattern will, no doubt, endure.

Strategic Calculations

It is tempting to accuse particular leaders of persistently promoting Moscow's conditions. But that does not seem to be the whole story. US administration works based on a assumption understood by seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The White House presumes that it is impossible to pressure the Kremlin to abandon the areas that it currently occupies in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, US leadership does little to prevent Kremlin actions, through diplomacy or military means, from believing that the status quo will not evolve additionally in its advantage in the coming year.

Opposing Positions

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its supporters are coming close to fatigue. Their reason to sign a deal that does not give them the maximum possible gain is almost completely absent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's government remains highly assured in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing lives and land but averting a total frontline collapse until situations evolve in its favour.

Current Realities

Realistically, there are no genuine requirements for a armistice. Now, personal considerations are coming into play: leadership ambitions to negotiate peace and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any plan Kyiv finds unacceptable, so that their priority does not switch to domestic problems. And although their objective will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These two forces are influencing discussions.

Summary and Prospects

It took a mere seven days to eliminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, current information leaks, all achieved their purpose.

While new proposals based on established approaches are approaching, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to alter the situation, if they stand together and enhance their military capacity at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the coming months, largely rely on continued Western support.
